Most donated organs in the United States come from brain dead donors, while a small percentage come from patients who die in “controlled,” or expected, circumstances, typically after the family or surrogate makes a decision to withdraw life support. The number of organs available for transplant could be substantially if donations were permitted in “uncontrolled” circumstances–that is, from people who die unexpectedly, often outside the hospital. According to projections from the Institute of Medicine, establishing programs permitting “uncontrolled donation after circulatory (...) determination of death,” or uDCDD, throughout the United States has the potential to provide 22,000 more donation opportunities annually. In contrast, U.S. controlled donation after circulatory determination of death, or cDCDD, cases have increased progressively over the past decade from 87 to 848 donors, but currently account for only 10.6 percent of all deceased donors. Following the IOM recommendations, several projects exploring the feasibility of uDCDD were funded by the federal government, including a grant from the Health Resources and Services Administration that supported a pilot project in New York City in which the authors of this article participated.A key feature of our protocol, and indeed of many uDCDD protocols, is the initiation of preservation methods such as chest compressions and extracorporeal membrane oxygenation shortly after death in order to perfuse and preserve the donor's organs. Critics of uDCDD argue that the means of determining death deviates from generally ascribed principles. They assert that reinstituting circulation in order to preserve organs has the effect of “undoing” the prior determination of death. The result is that cDCDD is widely accepted and practiced routinely even though it only marginally increases the number of organs available for transplantation, and uDCDD is widely considered unacceptable despite being ethically embraced and proven to significantly increase organ donation opportunities in other countries. This article explores the evolution of this counterintuitive state of affairs and calls for a policy that, in line with the IOM report, allows for both cDCDD and uDCDD protocols. (shrink)

Meeting of the Minds records the proceedings of the S.I.E.P.M. conference held in Boston from June 14-16, 1996. The conference participants centred their attention on the relationships between medieval and classical modern philosophy. These relationships have been painted in dramatically different ways by those who have presented overviews of the two eras. Hans Blumenberg, in The Legitimacy of the Modern Age and his subsequent works, discovers the seeds of modernity in the medieval authors themselves. Leo Strauss and his followers see (...) a radical difference between the classical world views of the ancients and medievals and the successive layers of modern thought. These general portraits demand specifics, and the strength of the conference, whose results are contained in this volume, was that it provided many specific examinations of concrete relations between the philosophical positions of celebrated medieval and modern thinkers. Our hope is that this collection of papers will suggest the direction for further cooperative efforts on the interplay of the philosophical views represented by these two eras, and that the issues commonly debated by the medieval and early modern thinkers represented in this volume will give renewed consideration to important philosophical points that have been ignored in more recent debates. Through an interdisciplinary approach, I attempt to construct a partial ethno-agronomy of the Seneca people in late pre-contact times and examine it for relevance to modern agriculture.Diohe'ko, the Three Sisters, had been cultivated for at least five hundred years prior to contact by the Seneca, an Iroquoian tribe inhabiting western New York State. The Three Sisters, corn, beans and squash (pumpkins, gourds), were planted together in hills in fields, cultivated and harvested by work parties of women.Changes of village (...) sites and patterns of village movement respond to the adoption of agriculture as well as other factors. Evaluating land use, crop yields and carrying capacity, I question the accuracy of Seneca population estimates.The Three Sisters was an important cultural complex. The Sisters are protagonists of a number of Seneca tales, myths, ceremonies and legends.As an agricultural strategy, Three Sisters embodies several efficiencies in growth patterns, nutrient, solar and water use, harvest and nutritional use. Microhabitat manipulation was practiced by the Seneca. The plants exhibit a high degree of cooperation, or commensality, in the association.Some preliminary judgments can be made about specific varieties of the Sisters in use among the Seneca prior to contact. Northern Flint Corn, Cutshort or Cornhill Beans, and Cucurbita pepo such as Crookneck Squashes are likely the eldest varieties in the area.Three Sisters agriculture demonstrates qualities of permanence and sustainability, especially as related to the Seneca cultural fabric. A conservative ethic, like Handsome Lake's teaching, it binds together people in culture and people and nurture in nature. Mary Jemison, who farmed both the colonial and Three Sisters ways, seems to have favored the latter's “leisurely” approach. (shrink)

People v. Strauss-Kahn is an ideal lens through which to examine the operation of a criminal justice system that privileges the presumption of guilt, or, to use the words of the US Supreme Court in the 2012 decisions Lafler v. Cooper and Missouri v. Frye, has become “a system of pleas, not a system of trials.” It is both an excellent example of a transparent and objective invocation of the criminal sanction, and a sharp counterpoint to the vast majority of (...) cases where law enforcement conclusions are privileged and rarely second-guessed. As analyses of wrongful convictions have sadly but inevitably demonstrated, the screening methods of police and prosecutors are fallible. Moreover, the prevalence of “tunnel vision” once the decision to charge has been made means that few cases experience the kind of post-indictment investigation and reevaluation seen in the prosecution of Dominique Strauss-Kahn. Stage by stage, the Strauss-Kahn case illustrates how to counterbalance the presumption of guilt and give expression to the presumption of innocence in the pretrial period through vigilantly-invoked and enforced due process protections. Drawing from this examination, the paper will then explore how to approach this model process in the more standard cases, which typically see a fraction of the judicial, law enforcement, and defense resources afforded Dominique Strauss-Kahn. The Strauss-Kahn prosecution offers several insights, three of which will be sketched at the paper’s conclusion: a requirement that prosecutorial decision-making be subject to a reasonable doubt standard; vigilant and early enforcement of the prosecutor’s obligation to disclose information that is favorable to the accused; and finally, a requirement that a prosecutor explain in writing any decision to dismiss the felony charges in indicted felony cases, so that the factual, legal and policy bases of these decisions (numbering almost one quarter of New York’s superior court felony cases annually) can be analyzed and publicized. In this paper, we challenge the conventional wisdom that high‐quality news reports of questionable corporate business practices will stimulate various marketplace negative responses, which in turn, will pressure management to undertake actions designed to protect the organization's reputation. Analysis is confined to a relatively brief period of bad news relating to Citigroup, Inc. We conclude that while none of the expected negative marketplace responses are evident in widely available news sources, the CEO did exhibit significant concern and instituted a targeted (...) reputation risk management program. In the absence of a concerned CEO, analysts should not, we suggest, expect a management team to respond with reputation‐enhancing corrective action solely as a reaction to negative publicity regarding questionable business practices. There are several compelling reasons to expect that gender equality may serve to foster state environmentalism. However, most previous research on environmental politics has neglected gender. To help further our understanding of the connection between gender and environmental politics, the authors empirically assess the association between the representation of women in national Parliament and environmental treaty ratification, using a large sample of nations. The findings indicate that nations with higher proportions of women in Parliament are more prone to ratify (...) environmental treaties than are other nations. The results point to the importance of considering the role of gender in analyses of state behavior and environmental politics and are consistent with the argument of some feminist theorists that the exploitation of nature and the exploitation of women are interconnected. De La Torre faults these theologians for the ways in which their moral thinking participates in the oppression and marginalization of Latina/os, either through their silence or through their endorsement of specific polices. De La Torre concludes that the legacy of cultural and economic privilege and the oppression of Latinas/os are so [End Page 199] deeply embedded in the Eurocentric thinking that has dominated the field of Christian ethics that it cannot be the foundation for Latino social ethics.De La Torre’s aim is to “move beyond” Eurocentric modes of thinking rather than dwell on critique. This eagerness to move forward to the creative and constructive aspects of Latina/o ethics, however, limits the forcefulness of his critique of Euroamerican ethicists. De La Torre’s reading of Euroamerican ethics—and even the application of that term—is highly selective, both in terms of the thinkers chosen and the writings examined. De La Torre is clearly concerned with imperialism, immigration, and free trade, yet it is unclear what justice means in those contexts. Perhaps due to the powerlessness of marginalized Latina/os, criticisms of injustice weigh far more heavily than visions of justice.The concise length of this book broadens its appeal. Academics unfamiliar with some of the concepts and methodologies of Latina/o theologians will find this short introduction a useful starting point. The state of the art of contemporary philosophy and psychiatry is reviewed. Section 1 describes the new field as an international open society of ideas. Section 2 introduces values-based practice. Although originally a philosophy-into-practice initiative, values-based practice is now developing more strongly in areas of bodily medicine such as surgery. An example from surgery illustrates how values-based practice has been implemented as a partner to evidence-based practice in supporting shared clinical decision-making as the basis of best practice in (...) contemporary person-centered clinical care. Section 3 explores the difficulties presented by implementing values-based practice in mental health as illustrated by a case example of anorexia. This shows that these difficulties derive from the particularly intense challenges of values pluralism presented by anorexia. The resources of phenomenology provide the basis for an effective response to these challenges. Section 4 generalizes the argument of Section 3 showing that an effective response to the wider range of challenges of values pluralism arising across the board in mental health is available from the resources of the international open society of ideas of contemporary philosophy and psychiatry. The article concludes with a promissory note on values and a cautionary note on science. (shrink)

This article makes an analysis of Mabel Shaw's understanding of African spirituality and Christian theology that emerged while she worked as a missionary teacher for the London Missionary Society in Northern Rhodesia. It argues that post-colonial writing on missionary activity has tended to emphasize the negative aspects of the missionary movement, the consequence of which has been a failure to recognize the achievement of women such as Shaw. The freedom that the London Board of (...) the LMS gave to their field workers allowed Shaw to create a Boarding School for girls at Mbereshi that won Shaw acclaim as an educational practitioner. An instinctive belief in natural theology combined with a strong sense of the presence of God in loving action was critical in forming and shaping the practical application of her faith. While professionally it is apparent that Shaw `hit the glass ceiling' with her being overlooked as a candidate to become Mission Station Head she provides an impressive example of a woman who challenged perceptions of theology and denominational allegiance. Her radical thought on issues surrounding Christian spirituality had implications for the Christian movement as it became an agent of change in Central Africa. (shrink)

Some farmers in the Central Finger Lakes Region of New York balance their production between principles of peasant farming and capitalist farming. They struggle to extend their sphere of autonomy and subsistence production, while extended commodity production is often a response to external forces of the state and capital. This struggle, together with a quantitative increase of small farms, can be described as an instance of repeasantization. Based on inductive, empirical qualitative social research, this case study describes the (...) economy and social organization of six farms in the area under investigation and explores the applicability of the rich theory of peasant farming to agriculture in this community. Besides selling commodities to pay for many farming inputs and consumer goods, the farms produce for their subsistence and that of their community. They exchange products and services with other farms, they build networks of mutual provisioning, support, and mentorship, and try to take good care of the land. This paper shows that subsistence production and peasant culture are not restricted to the past or the Global South, but also exist as pockets of peasantness on six New York farms. The perspective applied in this paper suggests that principles of peasant farming may shape farming on other US farms, too, if we accept that these principles intersect with constrains of the larger capitalist market society in which they are embedded. The idea of civil society is one of the oldest and most contested in Western political and sociological thought. Among the social sciences, anthropology has been the discipline that has prompted the boldest critiques of the concept. This paper argues that the “revival” of civil society in Central and Eastern Europe in one particular field—that of environmental activism—has been contingent with the outcomes of EU enlargement policies. I introduce the case study of one of the most complex and (...) contested transport development projects in Central Eastern Europe: the Budapest Ring Road. I maintain that within the EU enlargement project alternative forms of political power have been built from below and that they eventually come to compete with the state (and local governments) to influence decision-making processes. These forms, to be individuated in the emergence of environmental activism, take shape at local, state and transnational levels and aim, although often contradictorily, at restituting political agency under the condition of lowering public participation in decision-making processes. Wherever a government or state is concerned with the welfare of its citizens, there will probably also exist policies which compel the individual citizen to undertake or abstain from activities which affect that citizen alone. The set of theories behind such policies is collectively known as ‘paternalism’. It is not hard to understand why this term has developed strong pejorative overtones. Policies of this type appear to offend a fundamental tenet of liberal societies: namely, that the individual is best (...) placed to know what is in his or her interests. Paternalistic policies imply, and are concerned with correcting, failures of precisely this kind of judgement. And yet, at the same time, there is a popular consensus that compelling people to wear a seat belt when driving a car is a reasonable restriction of personal liberty. Paternalism may be difficult to accept in principle, but it is equally difficult to avoid in practice. Not surprisingly, the literature reveals a long heritage of debate in a wide range of academic disciplines. This debate reveals a failure to make progress in two areas in particular. First, analyses of paternalism often confuse policies which are actually concerned with correcting failures of market exchange — in particular, those concerned with insufficient or imperfect information — with those which are genuinely paternalistic. One objective of this paper will be to clarify the difference between these two kinds of policy. (shrink)

Drawing on a wide range of sources, from John Money’s sexological writings to Simone de Beauvoir’s dictum, (...) “One is not born a woman, but rather becomes one,” Anglophone feminists in the 1970s developed the distinction between sex (understood as anatomy) and gender (understood as social identity) to argue that a woman’s biological sex ought not dictate the kind of work she should do or the kind of life she should live.1 In her landmark 1975 essay, “The Traffic in Women,” Gayle Rubin coined the phrase “sex/gender system” to examine “the set of arrangements by which a society transforms biological sexuality into products of human activity, and in which these transformed sexual needs are satisfied.”2 In more recent years, however, the distinction 1. It is worth mentioning that sex in Rubin’s sex/gender system refers to sexual practice rather than the distinction between male and female. This understanding forms the basis of her theoretical disagreements with Judith Butler, who preserves the semantic ambiguity of sex (as 342 Petrus Liu between sex and gender has taken on an entirely different meaning as it comes to inform transgender movements and politics seeking to decouple a person’s sex assignment at birth from their future gender identity. At the same time, theories of intersectionality, women-of-color feminisms, and transnational feminisms have all developed their own theses of gender variability to contest the myth of the universal woman. The life of gender—in academic theory, politics, and social movements— has confounded the original intentions of its American theorists. It is clear that there is no singular or stable account of gender; rather, gender is always in a state of flux, incessantly rethought and reforged by the demands of an increasingly complex and asymmetric world.3 Gender is always a translation—from one discipline, context, or language to another—ineluctably intertwined with the geopolitical problems created by the violences of imperialism, colonialism, and transnational capitalism. The translation of gender into non-European languages, such as Chinese, raises questions about whether spaces previously resistant or exterior to world capitalism are now being assimilated and enfolded into the structure of neoliberal globalization defined by the Washington Consensus. Against this view, some critics maintain that China’s precipitous ascent presents an alternative model of development for the Global South called the Beijing Consensus. Considering how gender has entered different languages, including Chinese, to create new coinages that may at times appear as instruments of an imperial takeover, Judith Butler argues that the translation of gender actually offers a path of linguistic humility for English, a reminder that we cohabit a multilingual world in which no one ever owned the term.4 But how exactly do we describe that complex, multilingual world and how does gender both gender and sexuality) as the point of departure for a different kind of feminist inquiry. Irigaray raises the question of sexual difference. Yet there are moments at which Irigaray’s own pursuit of this question recapitulates the kind of universalism it is meant to combat. She remains ensconced in judgments that close down the attempt to think beyond sexual difference. The article pursues this line of thought particularly in relation to her figuring of Antigone, suggesting that there is a need to open up sexual difference so that it does not function as a universal discourse, but (...) is open to other kinds of difference, for example, racial difference. Hòa Hảo Buddhism belongs to that traditional lay and frugal buddhism encouraging practicing at home (tu tại gia) while being engaged with the world (nhập thế). It appeared in Southern Vietnam at the end of the 1930’s. Obviously, colonial contest and economic depression have played the part of a powerful catalyst in the spread by a young charismatic and reformist character of this millenarianism. Then, during three decades of postcolonial and cold wars (1945–1975), this New Religious movement hardly expressed its (...) Buddhist ethic of social statements in order to lend moral support and material protection to the local peasantry. Eventually, at the end of the war, this autonomous Buddhist community finally tried to morph again into a legal religion at a time when the Vietnamese Communist Party had to urgently impose a new sovereign socialist republic (1976). In other words, the new regime had to reunify the Nation and build a new secular state. In the southern part of the country, the replacement of a former liberal regime (Republic of Vietnam) by a socialist republic (called formerly a Democratic Republic in Northern Vietnam) completely changed the nature of the State-Church relations. Therefore, many religious groups’ agencies suffered a drastic blow as these groups were subordinated to the Patriotic Front and its mass organizations. Nevertheless, in 1991, the reorientation of the religious policy officially reaffirmed the religions’ social utility. Since then, new debates emerged to define the nature of the social actions of religious groups and then to delineate the legal sphere of their activities in this secular state. This essay intends to question how the two notions of being engaged with the world (nhập thế) and that of the secular state (nhà nước trung lập thế tục) interacted during these last decades. To tackle this pivotal issue, we focused on the specific implementation of Hòa Hảo social activism, from 1940’s until now, to underline how this activism evolved under different political regimes and how a new culture of social service has been promoted since the Hòa Hảo official church was recognized in 1999 and achieved years later. It questions more generally how religious groups can negotiate with the state for the emergence of a civil society or, at least, for the acceptance of their own tribute to the prosperity of the Nation.
